IMPHAL, Oct 3: Two resolutions including a government resolutions and another private member resolution were passed today unanimously by the House on its second sitting of state Assembly.
The government resolutions ‘Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993 (Act No.46 of 1993) was passed today by the House after a thorough discussion.
This Act was enacted by the Parliament for the prohibition of employment of manual scavengers as well as construction or continuance of dry latrines and for the regulation of construction and maintenance of water seal latrines and construction and for the matters connected therewith or incidental thereto.
The leader of the House chief minister, O Ibobi Singh today moved to pass a resolution for application of the Act in the state of Manipur in pursuance of clause (I) of article 252 of the Constitution of India.
The House unanimously without having much discussion and without much objection from the opposition bench passed the resolution.
However, during the discussion, opposition MLA O Joy made his observation that the resolutions has been already enacted by the Parliament and there is little meaning for more indepth discussions for passage by the Manipur Assembly.
The House also today unanimously resolved on the establishment of a separate High Court for the state for the fourth time after the motion was moved as private members resolution jointly by the opposition MLAs from MPP led by O Joy, Dr Ng Bijoy Dr Ibohalbi and RK Anand in the House today.
While moving the resolution O Joy observed that establishment of separate High Court in the state is a long pending demand and earlier the House had passed the same resolution on three occasions.
He recounted and said it was initially passed in 1982 when Y Yaima was speaker of state Assembly. It was resolution no 28 of the House. The second time resolution was taken during 1997 during tenure of W Nipamacha as Speaker on May 11, 2007.
Since then there has been no follow up from the Central government for the establishment of the separate High Court in the state, O Joy observed.
He further mentioned that it is mandatory under the Constitution of India to establish a separate High Court in a state but the Centre is not converting the spirit of the Constitution into action, he observed.
Its a violation of legal rights in the state, he observed adding that apart from this, various grievances and inconveniences have been facing by the lawyers of the state due to the lack of separate High Court of the state.
He also urged the state government through the House to adopt another resolutions in order to press the Centre.
Dr Ng Bijoy Singh while taking part in the discussion said that considering the enrolled numbers of cases in the Guwahati High Imphal Bench and existing infrastructures, accommodations it is a must for establishing a separate High Court for the state of Manipur.
MLAs I Ibohalbi and RK Anand who also took part in the discussion insisted that having separate High Court is a must for the state considering the existing trend of enrollment cases in the Guwahati High Court Imphal benches.
Due to the lack of separate High Court in the state, many talented lawyers and other legal experts of the state have ended up their exposures at Guwahati. So strong pressures should be given from the state government to the Centre, they insisted.
State law and legislative affairs minister Th Devendro while taking part in the discussion insisted to come to the point by the movers of the resolution in the house while deliberately expressing his desire to take another firm resolution of the House.
After the deliberations from the law minister another resolution which would the fourth one was passed by the House today.
