TRANSCRIBE OF PERSONAL STATEMENT MADE BY Ms. MARY

With my friend Daisy, I reached New Delhi on the 11th of December 2008 from Chandigarh. We already entrusted Mr. Lalboi to look a room for us that we would be taking on rent once we are at Sikanderpur, Gurgaon. On reaching Gurgaon at around 06:00 P.M. the same day, we went to see the room that we will be taking on rent, where we leave some of our belongings and left the room to stay outside and spend the night at our friend’s place.

On the 12th of December 2008, we went back to our room at around 9:30 A.M. and met the Landlord to pay the month rent as well as any other security money that he may be charging us. The Landlord told us that he being busy would not take the money at that time but would come to us later in the evening to discuss and take the money. We then left for our room to clean and tidy up the room, which we did for the rest of the day. At around 10:30 P.M. that same day we went to bed and very soon felt asleep.

On the intervening night of 12th- 13th of December 2008, the very first night we spent in our now, new room, at around 2:00 A.M., I got awaken suddenly by a loud knock at our door. My friend too, too scared to say or do anything looked to me wondering who that could be at such an odd hour. We then heard a voice saying that, “this is your landlord, open the door”, to which I replied and asked what he wanted. The man than shouted, “Don’t you know that I am the owner of this house and I want to come inside”. We then pleaded to this voice, to please come back in the morning and talk to us about whatever he wanted to, the next day. To this the man replied that if we do not open the door, he would force himself inside by breaking the window glasses. We continued pleading that, if it is the house rent that he wanted, he can come and collect the next day. The banging on our door getting louder and fearing that something bad could be happening to us, I then started dialing the emergency police helpline number 100 consecutively for three times to which I do not get any response each time. The man then started to hit the glass on our window. I than dialed the number of Mr. Lalboi telling him about the situation and praying to him for help. To this, Mr. Lalboi came with some friend trying to help us. Some sort of scuffle then ensued outside for a few minutes after which those persons who came to our rescue were scared away by the attacker. Now the landlord succeeded in forcing himself inside our room, and started hitting us immediately with an object, as big as an adult wrist in diameter and around 4(four) foot long. We than ducked ourselves inside our quilt to save ourselves from the attack. I told him that I will pay him the rent and prayed to him to stop hitting us and leave us. He then forced us to packed our belongings and leave the house immediately within 5 minutes during which he continued hitting me and my friend again and again, me on my back and thigh with that stick he is holding. We then, as fast as we possibly could, pack our belongings and dragged them outside in the verandah in front of the room during which the landlord continued to hit us over and over again and again. He then took Rs 3500/- from us.

Two other men now arrived on the scene and talked to the landlord, I snatched the distraction to run away asking my friend to follow me. I then managed to run away leaving my friend behind. Afraid that something bad could happen to my friend, I could not ran far, so, I came back and hide myself nearby where I could hear the voice of my friend crying out to these men to stop beating her and let her go. Unable to bear the pain and hurt from my friend’s voice, I tried helplessly, to look for help around where I am, due to which the attacker spotted me back. One of the men (not the landlord) than chased me and started hitting me the moment he caught me. This man threatened saying to me that, “I am going to rape you”.

The three man than drag both of us to another room. Two of these men, the landlord and the person who chased and caught me continued hitting us all along the way. Once they dragged us inside this other room, these three men started molesting us, one of them hitting me with his hand on my head and body. Both the landlord and the person who caught me tried to sexually assault me by pushing me up against the wall, the landlord holding my hand and the other person using his hand and body. Right at this moment, three middle-aged women arrived on the scene and called the three men out and talked with them. During this some policeman arrived on the scene with their vehicle which we could see parked right outside in front of the room we were dragged into. On seeing the policemen, I tried to run to them, honestly believing that they are the only one who could keep us safe and protect us. One of women stood on the door telling us not to come out, stopping me from going outside and then closed the door of the room where we are put into. Knowing that the arrival of the police is our only last chance to safety, I asked my friend to follow me and forced our way out of the room where they forcibly put us into. Me and my friend then ran out and into the police vehicle parked outside.

The Police then take us back to the previous room and asked us to put our belongings back inside the room which we did, despite the bodily pain and injury that we suffered. The police than take us to “SHRI RAM MEMORIAL HOSPITAL” Sikanderpur, Gurgaon for medical checkup. At the hospital, we are told that we have to arrange Rs. 2000/- per head for getting ourselves admitted. Leaving all our money behind at our room, we managed to get admission only for my friend as she was being suffering the more physical injury comparatively with mine. Later the same day with the pain and injury I suffered becoming more and more unbearable, doctor admitted me too for another round of treatment.

On the 14th December, 2008, at around 10:00 A.M., accompanied by the police, I went with some friend to check our belongings where I discovered that my money (Rs, 11000)which I put inside one of my bag that I left behind and my digital camera was missing which I immediately informed the policemen who were with me there. Later in the evening that same day, my sister along with some friends went back to our room to take back our belongings with the police.

I and Mary arrived at New Delhi from Chandigarh on the 11th of December, 2008. The next day, on the 12th of December, 2008, we spent the night at this new room that we took on rent. At around 2:00 A.M. on the 13th of December, 2008, I heard a loud knock at my door that suddenly woke me up. After a few more banging on our door, my friend asked who was at the door and what he/she wanted. To this a person replied, which I believed him to be saying that he was the house owner, as my knowledge of Hindi is very limited. Being very afraid to open the door at such time of the night, we replied back to this man that we would meet him the next day and answers to whatever he wanted to know, as it was already too late for a visit. The man continued shouting and continued hitting at our door more and more louder each time. The man then started to hit the glass of the window to our room trying to enter inside our room. Too scared and not knowing what to do, my friend Mary dialed her phone and tried to call for help. She does not get any response for a few times which by now, I’ve learnt that she was trying to call the police. She than tried calling another number, a number of our friend staying nearby, who we believed immediately come to our rescue on hearing our call of distress as a banging on our door stopped for a few minutes and I could hear a sort of scuffle in front of our building. Very soon, the scuffle ended and we heard another round of banging on our door immediately. We believed that the person who comes to our rescue failed as they were either injured or scared away by the person who is/are attacking us.

The landlord now, after breaking the glasses of the window, made a forcible entry inside our room and immediately started hitting the both of us with an object/stick he is holding. He then asked us to pack all our belongings immediately and leave the room within five minutes. He continued hitting us all along while we are begging him to stop hitting us, as we are packing our clothes, luggage and our other belongings. After making us put our belonging outside in front of the room, he took Rs, 3500/- from Mary. He continued to hit us with the object he is holding all through this.

Two more man arrived on the scene and talked to the landlord. At that moment, my friend told me to follow her and run away. My friend succeeded in running away while they caught me on the step trying to run away too for my safety.

Now, the landlord and another man started beating me again, using their hands and feet this time around. The landlord now tried to suffocate me my grasping me very hard on my neck, with his bare hands. Once he removed his hand I started gasping heavily for air and cough for sometime.

Now they started dragging me outside while hitting and kicking me from time to time all the way and put me in another room for sometime. They then, after a few minutes, pulled me out of the room and started hitting me again. This time they asked me question in Hindi which I could not answer them back properly as I am not good with Hindi as well as due to the reason that they continued hitting me again and again on all parts of my body using their hands and feet. Then they dragged me for some distance and asked me questions which I begged them to ask me in English. One of the man then said to me one English word “SEX” and showing me 4 (four) of his fingers which I in no way understand what he intended to convey to me in doing so. I cried, begged to them and prayed to let me go as they continued hitting me. One of the men tried to kiss me by forcing himself onto me but I managed to turn my head around away from his mouth.

Then they noticed my friend Mary appearing close by crying for help and immediately chased after her. They then dragged Mary to where we are hitting her as they come. Then they dragged us both inside another room. Now they stop attacking me and all of them started attacking Mary. I believed that they are trying to sexually assault her from their action. Right at this moment, around three women arrived on the scene and called the three men out. A moment later, some policemen arrived too on the scene with their vehicle which I could see parked outside. We immediately tried to run to the police, one woman who is standing at the door stopped us and closed the door, not allowing us to go to the police. Mary then told me to follow her and we succeeded in getting out and get inside the police vehicle parked in front of the room.

The policemen talked with the women for some time and took us back to the room where we leave our belongings behind. Due to the harassment, assault and beating I could barely stand straight, with my body hurt all over. The policemen then asked us to put all our belongings back into the room which we did despite the bodily injury and pain we already endured.

The policemen than took us to “SHRI RAM MEMORIAL HOSPITAL” Sikanderpur, Gurgaon for medical treatment. Despite without any money in hand, I am immediately administered treatment due to my grievous state of injury on the promise that we are going to arrange whatever money they are going to charge as after sometime. But my friend was denied admission despite her injury as she too did not have any money with her for her admission and treatment. Due to my state of injury, I could not remember what followed as I am semi-conscious by that time.

On the 14th of December 2008, few people accompanied by the police went to our room to check our belongings. Before they go, I requested them to look for my purse which contains around Rs 3000 inside which I left behind. The people who went to check could not find the purse and money and told me that they informed the police accompanying them about the same.
